This archive operates as an educational preservation project under the Fair Use Doctrine (17 U.S.C. § 107) and the UNESCO Charter on Preservation of Digital Heritage (2003).

The original smalensk.org website (2010-2014) no longer exists. We preserved this cultural heritage content for:

  • Educational and research purposes
  • Cultural preservation of Belarusian heritage
  • Historical documentation

Notice Requirements (17 U.S.C. § 512(c)(3))

To file a proper DMCA takedown notice, your written communication must include:

  1. Physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, with sufficient detail for us to locate it (URL)
  4. Your contact information (address, telephone number, email)
  5. Statement of good faith belief that use of the material is not authorized by copyright owner
  6. Statement of accuracy under penalty of perjury that you are authorized to act on behalf of the copyright owner

What Happens After Notice

Upon receipt of a valid DMCA notice, we will:

  1. Review the claim - Evaluate whether the notice meets DMCA requirements
  2. Consider fair use - Assess if the use qualifies as educational fair use
  3. Act appropriately:
    • If claim is valid: Remove or disable access to the material
    • If claim is invalid: Provide explanation
  4. Notify you of our decision within 14 days

Counter-Notification

If you believe material was removed in error, you may file a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the material removed and its location before removal
  3. Statement under penalty of perjury that material was removed by mistake or misidentification
  4. Your name, address, telephone number, and consent to jurisdiction

Repeat Infringer Policy

Per DMCA safe harbor requirements, we maintain a policy of terminating access for repeat infringers. However, as this is a static educational archive with no user-generated content, this primarily applies to removal of archived material upon valid copyright claims.

Good Faith Consideration

Before filing a takedown notice, please consider:

  • This is a non-commercial, educational archive
  • The original source (smalensk.org) no longer exists
  • We preserve cultural heritage that would otherwise be lost
  • All content includes author attribution
  • We will cooperate with reasonable requests
